Q - I bought a flat in a house that has four flats. As owners we jointly own the Freehold. The flat I bought had two garages on the deeds and the previous owner seperated them from the flat deeds so she could keep them. I knew nothing of this when I bought the flat. I now realise that the land on which the garages are built remains in the ownership of the Freehold, does that mean we should have been receiving ground rent and can we back date it? 

A - The key to this is the freeholder/leaseholder agreement, so really you need to direct this question at a specialist legal leasehold specialist, which you can find through Alep as the agreement needs to be read and understood in full to give you a bespoke answer. 

The leasehold specialist will need to establish whether it was legal in the first place to seperate the garages bearing in mind the planning permission clause.
